This is a question I ask myself quite frequently.

Old Navy jeans fit me well, but I'm more of the no-waist, muscular thighs, no butt type. They have five different fits. I usually wear the "slightly below waist" fit. They don't have the gapping problem in the back but aren't "mom jeans". I haven't tried their new "boy cut" fit yet.

Gap, Old Navy and Banana Republic pants all fit similarly, but I always wear a size bigger at the Gap and Banana Republic than at Old Navy. In addition, Old Navy's sizing is all over the place - I have pants in sizes 10, 12, and 14 that all fit me about the same. I actually have some 10s that are bigger than some of the 12s.
