So sad.That poor little girl.
This angers me to no end. If I "lose control" of my car and cause an accident in which I hit another car, I am liable. But this driver hits two cyclists and it's brushed off and there are no charges? I am absolutely outraged. Between the tears, that is.

This is relevant and in no way do I want to take away from the original post.
My Grandson is 7 years old too and this week his Mum was driving (on her own) and hit a patch of oil/diesel and her car went out of control for quite a distance. The car subsequently finished up facing the wrong way on the opposite side of the road and finally hit a grass verge and ended up on it's side, along with a windscreen that had blown. Thank goodness, she walked away with only a scratch on her little finger. So many things seem to be happening to my son and his family recently. However, at least my Grandson has both his parents.
BUT after reading this, my goodness, does it put everything into perspective.
The look on that poor child's face, absolutely tragic and heart breaking. No matter what anybody tries to do, nothing is going to ever be the same for this young child.

I didn't there, but I did elsewhere. I had to stop because, even in this tragic situation, there was scum crawling out of the woodwork to blame the cyclists for having the audacity to ride.
So, no. I was scared to read the comments anywhere but here at TE. But yeah, now that I look at the site itself, I realize that it would be a safe and sane site.

This is completely tragic and senseless. No paying attention isn't an accident, it is not being committed to driving because of other poor ability or some distraction. When my husband rear-ended someone because he was driving to close, we were punished by having raised insurance. Texas is a no-fault state so by not breaking a law he wasn't ticketed. I am assuming this man's insurance will at least have to pay out for the funeral expenses right? There is no amount of payment that can heal that little girl though.
I do believe the driver has a long healing process no matter the reason he left the roadway. Several years ago my father broadsided a car that made an illegal turn in front of him. One passenger, the same age as my brother (both adults at the time) was killed. My father had no fault but he was devastated, it was an incredibly painful experience. Same note a relative hit a man that was high walking in the middle of a very dark interstate frontage road at 11:00 at night after my relative left work. The driver (my relative) swerved but clipped the man and killed him. He had a lot of trouble dealing with the blame he placed on himself even though there was very little more he could have done.
Texas laws are terrible at protecting vunerable road users. In this area the same story could be written with a farmer driving his tractor on the shoulder and it would be the same thing "a horrible accident".
